A 27-year-old from North Wales has been fined and hit with a criminal behaviour order after he was caught peddling counterfeit designer products to shoppers on the streets of Liverpool.

The offence

Martin McDonagh, of Queensferry in Flintshire, was spotted on 25 July last year approaching passers-by in the city centre and opening a bag filled with items for sale. Officers on patrol were alerted and located him on Paradise Street, where they discovered the bag contained fake perfumes from brands including Hugo Boss, Chanel and Dior, alongside imitation Apple products.

He was subsequently charged with six counts of selling counterfeit goods.

The outcome

McDonagh appeared at Liverpool Magistrates’ Court on Wednesday, April 15, where he was issued with a fine and a Criminal Behaviour Order.

Under the terms of the order, he is banned from having any fake or unauthorised replica cosmetic or electrical item anywhere in Merseyside. He is also required to produce a certificate of authenticity or proof that a product is genuine if asked to do so by a police officer or Trading Standards official.

Merseyside Police response

ASB Preventative Orders Sergeant Rachel Hassett said: “This order prevents McDonagh from possessing fake goods and harassing members of the public to purchase them.

“This type of offending also has a detrimental effect on retailers and their business, and there is ongoing partnership work to help protect them from such offences.

“If you see McDonagh breach the conditions of the order, then please report this to Merseyside Police.”
