A 34-year-old man from Barry who sexually assaulted a woman with a sex toy before raping her has been sentenced to 10 years in prison.
Toby Rogers appeared at Cardiff Crown Court where he entered guilty pleas at an early stage to charges of rape, assault by penetration, and assault by beating.
Victim impact
Reading her statement to the court, the victim said: “I’m trying to rebuild my life and move on.”
She told the court she suffers from anxiety as a result of her ordeal.
Judge Lucy Crowther commended the woman for her “bravery and resilience” and described Rogers’ offending against her as “hideous”.
Defence
Clare Wilks, representing Rogers, told the court her client had no previous convictions and was of previous good character with a “strong work ethic”.
“He knows he faces a lengthy custodial sentence today,” she added. “The defendant is genuinely remorseful.”
The court heard that Rogers has experienced “poor mental health” and has previously been sectioned. Both a pre-sentence report and a psychiatric report were prepared ahead of sentencing.
Sentencing
Rogers’ early guilty pleas entitled him to a one-third discount on his sentence. Judge Crowther told him he would be required to serve two-thirds of the 10-year term in custody before being released on licence, with time already spent on remand counting towards the total.
He was made subject to a 20-year restraining order preventing any contact with his victim and must register as a sex offender for life.
Rogers was also ordered to pay a statutory victim surcharge within four months of his release.
